1. Trade License

Trade License is a license or permission issued by municipal corporation granting permission to carry on a particular business at a particular address. It ensures that the citizens are not adversely affected by health hazard and nuisance by the improper carrying of trade. It is issued by the municipal corporation of the place where business is located. A trade license is a permission to carry on a specific trade or business at the premises for which it has been issued.

An application must be made before the commencement of the activity. However, some state governments allow 15-3 months time to seek a trade license. Licence once issued requires periodical renewal on annual basis. Application for renewal must be filed at least 30 days before expiry of licence. The process of Trade license registration is often a time consuming and expensive process

Documents Required For Trade License

  • Pan Card of the establishment in case of company, LLP or Firm.
  • Canceled Cheque and bank statement of the establishment.
  • Certificate of Incorporation, MOA and AOA of the company or LLP/ Partnership Agreement as the case may be.
  • Premises Proof of the establishment in the form of Sale Deed, Electricity Bill/water bill and NOC from owner.
  • Colour Photograph, Pan card and ID Proof and Address Proof of all Directors/ Partners.
  • Front-Facia Photograph of the establishment with Display of goods traded from the premises.
  • Site/Key Plan Showing the area under the occupation of the applicant earmarking the neighbourhood of the site.

State Wise Application of TL

While some state has made it mandatory to obtain a trade license, but in some states it is optional. The kind of license and license fee also differs from state to state. Some states charge a monthly fee while others charge a % of the turnover.

Different categories of trade license

a. Industries license: small, medium and large scale manufacturing factories

b. Shop license: Dangerous and Offensive trades like a sale of firewood, cracker manufacturer, candle manufacturer, barber shop, dhobi shop etc.

c. Food establishment license: Restaurants, hotels, food stall, canteen, the sale of meat & vegetables, bakeries etc.

Eligibility for a Trade license

a. The applicant must have crossed the age of 18 years

b. The applicant must not have any criminal records

c. Business must be legally permissible

2. PSARA License

PSARA License is required to be taken by such entities who wants to start their business of Employing Private Security Guards other than Police. The act which governs this business is Private Security Agencies Regulation Act, 2005. It is generally known as PSARA License. It can be applied district wise or state wise as per requirement of an entity.

It is mandatory as per law and it will be issued by State Controlling Authority on making application to it. Serious Penal Consequences are required to be faced if any entity starts its business  without applying for such license. Since it involves security issue, this license is granted only after proper inspection and checking for respective entity who applied for PSARA License.

Eligibility

PSARA License can be applied by any form of business whether it is a Individual, LLP, Company, Association of Persons, Partnership Firm.

Validity

PSARA License is valid for a period of 5 years and can be renewed after that for another 5 years.

3. APEDA Registration

Agricultural & Processed Food Products Export Development Authority (APEDA) is a government organization established in 1985 through an act for the development and promotion of export of scheduled products.

The objective of APEDA is to promote schedule products export and to achieve this various functions has been undertaken by this body under the regulation of central government. Central government lays down the rules and regulation and implements through this body for the efficient administration of APEDA Act.

Documents are required for registration

  1. Duly signed an application form
  2. Copy of Import-Export code issued by D.G.F.T.
  3. Bank Certificate duly signed by the authorities
  4. Bank A/c. statement of the bank account of the firm (for latest 2 months)
  5. Canceled cheque
